New Delhi: With Rajiv Roy's arrest, this gruesome incident emerged to the public. Sanjay Roy, a suspended civic police volunteer, has now been sentenced to life imprisonment for the gruesome exercise of raping and murdering an active doctor in RG Kar Medical College and Hospital. This verdict was dealt to him by the Sealdah court along with a fine of Rs 50,000. 

The doctor's body was discovered in the seminar room of the hospital. Roy was arrested the day after the incident. She was discovered a day after her colleagues last saw her. At her funeral the relatives of the victim said, 'Not only did she get justice, but her killer was punished with the most severe sentence possible. My only daughter and only son is now without a mother.' 

A lawyer while elaborating on the sentencing, mentioned, “The court directed the state to give compensation of Rs 17 lakhs to the victim's family,” adding that “A fine has also been imposed under 3 sections of BNS on the convict.”

To which the CBI had affixed the most stringent punishment to the convict. “The most stringent punishment is requested in order to server expectations of the society,” elaborated the CBI backed lawyer. However, throughout the proceedings of the case, Roy staunchly claimed his innocence. He always insisted on being a victim of conspiracy perpetrated against him.

“I maintain that I have done nothing wrong and am being charged for something I have not done, and I am in fact being framed," said Roy in court.

Roy's allegation of being framed has already been cast into doubt by the Additional District and Sessions Judge Anirban Das of Sealdah, who at the end of this hearing on Saturday found Roy guilty in the matter. He still claimed that he is innocent in the matter and is a victim of conspiracy against him.

The downfall of the postgraduate trainee, disgraced Kate, and the cruel rape and subsequent murder shocked and angered national sentiments as well as triggered the disruption of law and order in the country on August 09 during the annual break.

Roy was taken into custody on August 10, a day subsequent to the discovery of the dead body of 31 year old medic in a seminar room in the hospital.

On Saturday, the judge made a reproachful pronouncement against Roy for the doctor’s sexual assault, and strangle death, and found him guilty in accordance with Sections 64, 66 and 103(1) under the Bharatiya Nyaya Sanhita (BNS).

According to Section 64 of the BNS is accompanied with punishment of 10 years to life imprisonment. Section 66 which focuses on punishment for a person responsible for the vegetative state of a victim or inducing death sets the punishment to a minimum of 20 years and death/send them to life imprisonment. Section 64 is for rape and entails punishment for not less than 10 years and can go up to life term Section 66, on the other hand.

Section 103(1) under BNS which seeks for a penalty of death or life imprisonment for the one accused of murder has no set restrictions.

While passing the verdict, Sessions judge Anirban Das asserted that over the 160 page judgement, there were questions raised by the complainant and the father for the victim that would be answered categorically within the judgement.

The judgement also chided some actions of the police as well as the authorities of the hospital.

The Calcutta High Court has ordered that the case be investigated by the CBI rather than the Kolkata Police. The parents of the doctor who died are equally gratified that the court has done justice.
