Microsoft supported startup OpenAI informed the Delhi High Court that deleting training data for ChatGPT constitutes a legal breach from their end in the US. In relation to the latter statement, the company owning the popular AI chatbot ChatGPT further informed the courts in India that they do not have any operations in India making it impossible for the said courts to preside over the copyright case filed by the ANI News Agency. According to Reuters this information came through the news agency ANI at the end of operations that they had an open case with OpenAI in one of their courts in New Delhi.

Reuters further published that earlier on in January OpenAI on record had stated that they will acknowledge their decision to bar actions which in turn prevents the use of freely available information for the development of advanced products and services. The latter statement will also serve as a means to rebut the claims made against them by ANI News and countless others. The lawsuit also demands the removal of already stored data in ChatGPT pertaining to ANI.

Sam Altman has consistently refuted the claims stating that it’s AI systems use data that is publicly available. During a November hearing, OpenAI informed the Delhi court that it would refrain from further use of ANI’s content, but the news agency contended that its publications were still stored in the memory of ChatGPT and that it should be deleted.

The report mentioned that in its filing from January, the creator of ChatGPT disclosed that they are dealing with cases in the US relating with the data which was used to train the models. As the allegations are still sub judice, OpenAI is unable to remove the data as it is mandated by US laws to keep all data.

According to a statement issued by ANI, Edits, S has a 26 percent stake in Reuters and has stated that it is certain about the jurisdiction which the Delhi court possesses over this issue and that they will submit an extensive answer.

OpenAI, after raising $6.6 billion last year, has been preparing to shift from a non profit company into a business which is motivated by profits in order to capture more funding to remain on top in the expensive AI race.
