New Delhi: The Supreme Court of India on Monday, raised questions regarding the FIR filed by Gujarat police against Congress MP Imran Pratapgarhi for allegedly editing a video of a song that was deemed provocative. According to the Supreme Court, it has been established that it is a poem rather than something that is against a certain community's values.

This issue was brought to a panel of judges Abhay S. Oka and Ujjal Bhuyan. The apex court noted that the decision of the Gujarat High Court not to accept Pratapgarhi’s petition seeking to quash the FIR, did not take into account the meaning encapsulated within the poem.

Senior advocate, Kapil Sibal, representing the Congress MP contended before the judges that the high court order was improper in law and also noted how he brutality exercised the law. “It's ultimately a poem. It is not against any religion. This poem indirectly says even if somebody indulges in violence, we will not indulge in violence…”, remarked the judges further adding “That’s the message which the poem gives. It is not against any particular community…”.

The states counsel requested the court to defer the proceedings for some time so that he may prepare a statement in relation to the issue at hand. The court directed the counsel to first think through the matter before approaching the supreme court and after receiving all submissions, the supreme court postponed the hearing for three weeks.

On January 21, the Supreme Court ordered a stay of the proceedings against Congress MP Imran Pratapgarhi for allegedly posting an edited video of the song in Jamnagar, which was highly controversial.

On January 3, Pratapgarhi came under fire for his song which was highly controversial which he played while attending a mass marriage celebration in Jamnagar.

The 46 second video which Pratapgarhi shared on X showed him in a public flower showering ceremony as he showered flower petals on him. The video evoked immense controversy as the song was highly inflammatory and was deemed to undermine the countrys sovereignty and hurt the religious sentiments.Reason for the controversy song range from secterian violence to national disintegration.

The song is highlycontroversial in nature and among other charges is deemed religiously divisive,framework of violence, detrimental to cohesion, and songs which are deemed inflammatory against the religion of kingdom builders are prohibited.

The MP from Congress has objected to decision taken by the Gujarat HC on January 17 regarding his case petitioning for quashing the FIR against has been denied. The high court had remarked that the probe is at a very preliminary stage.
